Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website digitaldiscoverability.com and the Digital Discoverability Toolkit services (the "Service"), operated by 2643194 Ontario Inc. ("we", "us", "our"). By purchasing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service analyzes a website you submit and produces a report on its "answer engine" / AI discoverability — how large language model assistants (such as ChatGPT, Claude, Gemini, Perplexity, and Grok) respond to prompts relevant to that website's market. The report is delivered as a web page and a downloadable PDF, and a link is emailed to the address you provide. The Service is provided on a pay-per-use basis. No account is required.
2. Eligibility and your responsibilities
- You must be at least 18 years old and able to form a binding contract.
- You must have the right to submit the website URL you provide for analysis. You represent that your submission does not infringe the rights of, or violate any law with respect to, any third party.
- You are responsible for the accuracy of the email address and URL you submit. Reports and receipts are sent to the email you provide; we are not responsible for delivery failures caused by an incorrect address.
- You may not use the Service to analyze websites containing unlawful content, or in a manner that is unlawful, abusive, or intended to disrupt the Service or its providers.
3. Payments
- The Service is offered on a pay-per-use basis, and each tool is priced separately. Our current tool, the AI discoverability analysis, is US$29 for a full analysis and US$20 for a repeat analysis of a previously purchased report. We expect to add other tools over time, which may be priced differently. Prices may change at any time. Prices are shown at checkout in USD and may be presented in your local currency; the price shown at checkout at the time of purchase is the price that applies to that purchase.
- Payment processing and merchant of record. Payments are processed by Stripe, which acts as the merchant of record for your transaction. This means Stripe is responsible for the sale, collects and remits applicable sales tax / VAT / GST, and issues receipts. The charge on your statement may appear under Stripe's descriptor.
- Your card is charged at the time of purchase. If an analysis fails to complete, we issue a full refund of the amount you paid, as described in our Refund Policy.
4. Delivery, availability, and retention
- Analyses typically complete within a few minutes. Your interactive results page remains available for 90 days after completion, and you may download a PDF copy while the page is live. We email a reminder before the page expires.
- After the 90-day access window we delete the report content and remove personal data associated with it, retaining only the minimal transaction records we are required to keep. See our Privacy Policy.
5. AI-generated content — accuracy and no reliance
The report is generated in part by third-party artificial-intelligence systems and automated data sources. It may contain errors, omissions, or statements that are out of date, and it reflects model outputs at the time of analysis. In particular, the report may name or describe third parties (including competitors) based on AI-model responses; such statements are the output of those models and are not our assertions of fact. The Service is provided for informational purposes only and does not constitute professional, legal, marketing, or financial advice. You are responsible for independently verifying any information before relying on it. AI model behavior changes over time, and results are not guaranteed to be reproducible or predictive of future model outputs.
6. Intellectual property
- We (and our licensors) own the Service, its software, and its design. We grant you a limited, non-exclusive, non-transferable license to use the report you purchase for your own internal or business purposes.
- You retain any rights you hold in the website and materials you submit. You grant us a limited license to process your submission and third-party data solely to produce and deliver your report and to operate and improve the Service.
7. Third-party services
The Service relies on third-party providers (including AI model providers, search-data providers, web crawling, security screening, email delivery, analytics, and payment processing). We are not responsible for the availability, accuracy, or acts of those providers. Your use of the Service is subject to their terms where applicable.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any report will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, 2643194 Ontario Inc. and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service will not exceed the amount you paid for the specific report giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain consumer-protection rights).
10. Indemnity
You agree to indemnify and hold harmless 2643194 Ontario Inc. from any claims, damages, or expenses arising out of your breach of these Terms or your submission of a URL or content you did not have the right to submit.
11. Changes to these Terms
We may update these Terms from time to time. The "Effective date" above reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. The courts located in the Province of Ontario, Canada will have jurisdiction, subject to any mandatory consumer-protection rights available to you in your place of residence.
